SDG Laser is a tool product provided by Shenzhen Sculpfun Technology Co., Ltd.

When you use some functions of the software, we will collect some of your sensitive information after obtaining your consent. For example, in order to use the software's device search function, we need the software to obtain the MAC address. Refusing to provide this information will only prevent you from using the relevant specific functions, but it will not affect other functions you can use normally.

When you use our products and services, we will collect information that you actively provide when using the service or that is generated by using the service in the following ways to provide you with services and optimize our services:

 

1.1. Allow the software to take photos and videos.

In order to use the software's photo and slice function, we need the app's photo and video permissions.

1.2. Allow the software to read photos, media content, and files on your devices.

Including information and services about your use of our software, such as data collected gradually when you start our software, including the pages you browse, actions you take, information about the last time you started/used the software, and details of software operations, including operations time and number of functions, operation mode, time details of each operation (for example: operation time, number of operations, time spent on each page, frequency of function use), details of the operation route, especially the sequence of function operations. Provide us with data to optimize your operating experience.

1.8. Allow the software to obtain technical data.

Including technical information collected when you launch our software and that we agree to your use, including your Internet Protocol (IP) address or domain name of the device you are using, your login data, system type and version, Uniform Resource Identifier (URI) address, location information, system plug-in types and versions, operating system and platform, and other technology on the device you are using. In order for us to continue to improve your user experience.

Automated technologies or interactions: We collect technical data and usage data about your device and behavior (such as software operations and patterns). We collect this personal data from the computer hardware and software you use to operate the Software or from your mobile device through the use of cookies, server logs and other similar technologies.

4.How do we use your personal data

We will only process your personal data when the law allows us to, that is, when we have a legal basis for processing.

Subject to applicable law, we use your personal data in the following circumstances:

"Performance of contract": We need to perform a contract that we are about to enter or have entered into with you as a party, or take steps at your request before entering into such a contract;

We will not use your personal data for activities where our interests outweigh your impact (unless we have your consent or are otherwise required or permitted by law).

Subject to limited exceptions (for example, in relation to some of our electronic marketing), we generally do not rely on consent as the legal basis for processing your personal data. When we do this, you have the right to withdraw your consent at any time.

5.Sharing of your personal data

SDG Laser is part of an enterprise organization that has multiple legal entities, business processes, management structures, and technology systems. Any information we collect or you provide to us may be shared and processed by any SDG Laser entity in order to provide the Services.

We may have to share your personal data with the entities and individuals described below for the purposes for which we collect the personal data.

If necessary, we will disclose your personal data (subject to applicable law and any terms of business we may have with you) to:

Any person or entity to whom we are requested or required to disclose such information by any court of competent jurisdiction or by any governmental, tax or other regulatory, law enforcement or similar agency;

third parties to whom we outsource certain services, such as, but not limited to, IT systems or software providers, IT support service providers and information storage providers;

Third-party service providers who assist us with user analytics, such as Google Analytics; please note that this list is not exhaustive and there may be other examples that we need to share with other parties in order to provide the Service as efficiently as possible.

We may share your personal data with persons or entities outside SDG Laser, and we may sell or transfer portions of our business or assets to such persons or entities. Alternatively, we may seek to acquire or merge with other businesses. If our business changes, and part of our business (as the case may be) is sold, acquired, or merged with an entity, your personal data may be used in the same manner as set forth in this notice.

We require any person or entity to whom we disclose personal data under this Section 5 to respect the confidentiality and security of your personal data and to process it in accordance with applicable laws and regulations. We do not allow recipients of your personal data to use it for their own purposes, we only allow them to process your personal data for specific purposes and in accordance with our instructions.

6.Third party contractors and other controllers

As mentioned above, we may appoint sub-contractor data processors as required to deliver the Services, such as, without limitation, IT systems or software providers, IT Support service providers, information storage providers, who will process personal data on our behalf and at our direction. We conduct an appropriate level of due diligence and put in place contractual documentation in relation to any sub-contractor to ensure that they process personal data appropriately and according to our legal and regulatory obligations. 

Further, we may appoint external data controllers where necessary to deliver the Services. When doing so we will comply with our legal and regulatory obligations in relation to the personal data, including but without limitation, putting appropriate safeguards in place.

What is our legal basis?

It is necessary for us to perform our obligations in accordance with any contract that we may have with you.

It is in our legitimate interest or a third party's legitimate interest to use personal information in such a way to ensure that we provide the Services in the best way that we can.

In some cases, the parties which we use to process personal data on our behalf are based outside the EEA, therefore their processing of your personal data will involve a transfer of such data outside the EEA.

Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

We are committed to keeping the personal data provided to us secure and we have implemented appropriate information security policies, rules and technical measures to protect the personal data that we have under our control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss, including:

The ability to ensure the ongoing confidentiality, integrity, availability and resilience of processing systems and services;

The ability to restore the availability and access to personal data in a timely manner in the event of a physical or technical incident; And a process for regularly testing, assessing and evaluating the effectiveness of technical and organizational measures for ensuring the security of the processing.

We ensure that those who have permanent or regular access to personal data, or that are involved in the processing of personal data, or in the development of tools used to process personal data, are trained and informed of their rights and responsibilities in when processing personal data, and are obliged to respect the confidentiality of such personal information.

8.How long do we keep your personal data for

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for. This includes for example the purposes of satisfying any legal, regulatory, accounting, reporting requirements, to carry out legal work, for the establishment or defense of legal claims.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

We may make changes to this Privacy Policy from time to time. To ensure that you are always aware of how we use your personal information, we will update this Privacy Policy from time to time to reflect any changes to our use of your personal information. We may also make changes as required to comply with changes in applicable law or regulatory requirements. Where it is practicable, we will notify you by email of any significant changes.
